A Scott County grand jury indicted a Winchester woman on a Class 4 felony charge of aggravated violation of the electronic device law after a May 4, 2021 accident northwest of Winchester.
Makayla D. Brown, 27, was driving a 2022 Jeep Compass southbound on Sand Road when her vehicle left the roadway and struck a tree.
Brown was transported to a local hospital with serious injuries as was a two-year-old male passenger, who died at the hospital.
No dates or times have been chosen for the trial.
A grand jury hears evidence in a case and decides if there is enough evidence to bring charges against the defendant.
